Pleas heard by Solovan
ST. CLAIRSVILLE David Tarleton, 37, 40773 Mill Road, Flushing, was arraigned on one count aggravated vehicular homicide, a felony of the first degree occurring Nov. 28, 2011. He pleaded not guilty. A pre-trial was set for April 9 with plea agreement July 2 and trial July 17. He was released on a personal recognizance bond.
The accident occurred on County Road 10, Lafferty when a deer in path of his motorcycle caused a crash that killed Tarleton’s passenger, Cathy Kurucz, 45, of St. Clairsville. Highway Patrol officers stated that Tarleton does not have a license. He had been suspended for operating a vehicle under the influence. They added he had no motorcycle endorsement and the vehicle was not legally registered.
Several pleas were entered and two sentences were passed during Friday’s session of Belmont County Common Pleas Court. Judge John M. Solovan II presided.
Johnna L. Hughes, 25, 20801 Miller Road, Cleveland, was sentenced for illegal conveyance of drugs onto a detention facility, a felony of the third degree occurring Nov. 27, 2010. She will serve 60 days in jail and six months in EOCC, 12 months of ISP and 41 months probation. She will complete 80 hours of community service.
Marcus Matthew Bogetich, 26, 124 Pine Lane, Barnesville, pleaded guilty to possession of a weapon while under disability, a felony of the third degree occurring Oct. 4, 2011. Solovan noted he had a prior conviction of possession with intent to deliver. A post sentencing investigation and EOCC evaluation was ordered. Sentence was scheduled for May 18.
William Roy Linde, 49, 109 Fayette Street, Martins Ferry, pleaded guilty to one count possession of drugs, a felony of the fifth degree occurring Dec. 29, 2011. A post sentencing evaluation and Crossroads evaluation was scheduled. Sentence was set for May 25.
Terry Allen Baker, 26, 68370 Liston Avenue, Lansing, pleaded guilty to attempted illegal conveyance of drugs onto the grounds of a detention center, occurring Dec. 9, 2011. He faces a maximum sentence of 36 months. A post sentencing investigation was ordered. Sentence was set for May 18.
Vaughn Derrick Pope, 22, incarcerated at the Toledo Correctional Institution, pleaded guilty to harassment by inmate through bodily fluid, saliva, a felony of the fifth degree occurring April 30, 2011. He was given a sentence of six months to serve consecutive to his current sentence for robbery. He had been set to be released June 2013. Defense asked Solovan to consider that the incident occurred at a time of high excitement and Pope was in good health.
Jason Edward Hess, 29, 65140 Union Street, Neffs, pleaded guilty to two counts of trafficking in drugs, felonies of the fourth degree occurring Nov. 16, 2010 and Sept. 14. He faces a maximum sentence of three years. A post sentencing evaluation and EOCC evaluation was ordered. Sentencing was set for April 27.
Brian Lee White, 28, 1410 Center Street, Moundsville, West Virginia, pleaded guilty to two counts of burglary, felonies of the second degree occurring Nov. 15 and Dec. 6, 2011 when he trespassed into an occupied structure when others were likely to be present. A post sentence investigation and victim impact report was ordered, along with a Crossroads evaluation. He was released on a personal recognizance bond. Sentence was set for May 18.
A warrant was issued for Craig Dustin David Howington, 21, 6992 Candlish Drive, Reynoldsburg.
