Rupert sentenced in child sex case
ST. CLAIRSVILLE – John Patrick Rupert, 42, 1657 Belmont St., Bellaire, was sentenced on two counts gross sexual imposition with a child less than 13, a felony of the third degree occurring May 26, 2011. He was among numerous sentencing and plea agreement cases in Belmont Common Pleas Court yesterday. Judge John M. Solovan II presided.
Rupert will serve two years for the first count and three years for the second. Sentences are consecutive for a total of five years. He was designated a Tier 2 child victim offender.
Solovan noted that Rupert was found guilty of one count as a result of a trial and subsequently pleaded guilty to the second count. Solovan noted the lasting psychological and emotional harm to the victims, including one victim required to testify during the trial. He also noted the crime involved an abuse of trust.
He also observed Rupert’s abject failure to accept responsibility, lack of concern for the victims, as well as his denial and lack of remorse. He said Rupert had demonstrated a pattern of sexual violations and reckless and impulsive actions.
Solovan added that he would not consider judicial release for at least four years.
James Andrew Monogioudis II, 31, 416 Heiland Avenue, Yorkville, was sentenced to five years of community control sanctions for possession of heroin, a felony of the fifth degree occurring May 10, 2012. He will serve up to 30 days in Belmont County Jail and six months at EOCC.
Keith O’Bryan Streets, 35, 105 N. Third St., Paden City, was sentenced on a count of theft from Wal Mart, a felony of the fifth degree occurring Feb. 22, 2012. He will serve seven months in the penitentiary.
Solovan noted Streets’ extensive criminal history, including theft, failure to comply, battery, forgery, trespassing and contributing to the delinquency of a minor, demonstrating an escalating pattern of risky theft behavior with little remorse.
Trenton Smith, 20, Bellaire, came before Solovan for escaping EOCC. He had been given a deferred 36-month sentence April 27 on a count of child endangering, a felony of the third degree, as a result of a Bellaire case which left an infant child with broken bones. He had been ordered to serve six months in jail and six months in EOCC. Smith admitted the escape violation and sentence was deferred to Sept. 28.
Defense asked Solovan to consider the harassment Smith was subject to by fellow EOCC residents.
Emily Frances Stultz, 20, 201 Swales Boulevard, Elk City, pleaded guilty to burglary, a felony of the fourth degree occurring May 25, 2012, and one count receiving stolen property, also a felony of the fourth degree. She faces a maximum of three years. A pre-sentence investigation, victim impact statement and ESC evaluation were ordered. Sentence was set for Oct. 12.
Albert Bohandy Jr., 20, 226 W. South St., Barnesville, pleaded guilty to aggravated assault with a motor vehicle, a felony of the fourth degree occurring April 13, 2012.
Charges stem from an incident when after a loss of temper Bohandy attempted to cause harm to two others using deadly force. He faces a maximum of three years and the suspension of his licence. A pre-sentence investigation, victim impact statement and ESC investigation were ordered. Sentence was set for Oct. 26.
Jonathan Richard Haney, 26, 1800 Hill St., Martins Ferry, pleaded guilty to child endangering, a felony of the third degree occurring April 4, 2012 during the administration of excessive corporal punishment on a young child. He faces a maximum of 36 months. A pre-sentence investigation, victim impact statement were ordered. Sentence was set for Oct. 12.
No agreement could be reached in the case of Clifford Eugene Brown, Jr., 42, 312 E. Main St., Holloway, accused of pandering sexually oriented material involving a minor, a felony of the fourth degree occurring Dec. 20, 2011. Two counts deal with distributing, two with possession. He faces a maximum of 19 years.
He will go to trial Sept. 18. He waived a jury trial and elected to have the case tried by the judge alone.
A warrant was issued for Eric James Mueller, 29, 51953 Pipe Creek Road, Jacobsburg.
