Solovan hands out sentences
ST. CLAIRSVILLE – Several pleas were heard and sentences handed down during Friday’s session of Belmont County Common Pleas Court. Judge John M. Solovan II presided.
Benjamin Elwood Senkbeil III, 28, Wheeling resident, currently incarcerated, was sentenced to six years for burglary, a felony of the second degree, and obstructing justice, a felony of the fifth degree, occurring July 26, 2012. Counts will be served concurrently for a total of six years. The sentence will also be served concurrently with a sentence for parole violation he is facing in Pennsylvania.
Senkbeil and another had attempted a burglary of an occupied home. The resident took the stand and described the lasting fear of being present during an attempted home invasion.
Solovan noted Senkbeil’s extensive criminal history and lack of remorse as well as the risky situation he created.
“You fail to appreciate the fear you instill when you commit these types of acts,” he said. “You didn’t take anything except their feeling of well-being in their own home.”
Keith Edward Smith, 33, 57550 New Cut Road, Shadyside, pleaded guilty to burglary, a felony of the third degree occurring July 15, 2012.
Sentence was set for March 15. A pre-sentence investigation and victim impact statement were ordered.
Derek Haven Cross, 20, 63105 Boyd Ridge Road, Bellaire, pleaded guilty to one count burglary, a felony of the third degree and one count theft, a felony of the fifth degree, occurring June 20, 2012. Sentence was set for March 1. A pre-sentence investigation, victim impact statement and Crossroads evaluation were ordered.
Orville Dale Baughman III, 25, 53968 Krebs Hill Road, Clarington, pleaded guilty to one count theft of drugs, a felony of the third degree, and one count breaking and entering, both occurring Oct. 10, 2012 when he trespassed into the Powhatan Health Center. Sentence was set for March 1. A pre-sentence investigation, victim impact statement and EOCC evaluation were ordered. He faces a maximum of four years.
Patrick Shawn Conseen 29, 1326 Poplar St., Bellaire, was sentenced on one count theft and one count safecracking, felonies of the fourth degree occurring Oct. 16, 2012. He was given five years of community control sanctions. He will serve six months in jail concurrent with a Northern Division Court sentence, then six months EOCC. He will pay a restitution of $1,000.
Francis Vancamp, 42, 1 South Front St., Wheeling, admitted to a parole violation after being terminated from EOCC and was sentenced to 18 months at the penitentiary with credit for 365 days served. He was originally charged with receiving stolen property, a felony of the fourth degree occurring Jan. 13, 2011.
