Heslop now a Tier 2 offender
ST. CLAIRSVILLE Several cases were heard during Friday’s session of Belmont County Common Pleas Court. Judge John M. Solovan II presided.
Ellis Wilbur Heslop, 39, 205 Cleveland St., Tiltonsville, was sentenced for one count unlawful sexual conduct with a minor, a felony of the fourth degree occurring in 2007. The victim was 13-14 years old at the time.
Heslop will serve five years community control sanctions, six months in jail, six months EOCC. He is not to coach or participate with youth in a supervisory capacity.
He was designated a Tier 2 offender.
The victim chose to address the court. She spoke about the lasting impact on every aspect of her life into her adulthood.
“You are a very sick, selfish individual and a poor excuse for a man,” she said, adding that she and her family have felt intimidated by the defendant.
Defense said Heslop is remorseful for his crime.
He asked Solovan to consider Heslop’s prior clean record and the personal and financial repercussions he has experienced. Solovan noted the lasting effects on the victim and her family.
Russell James Kocher, 27, 72295 Colerain Road, Bridgeport, pleaded guilty to two counts of theft, a felony of the third degree, and one count Medicaid fraud by making false or misleading statements to obtain reimbursement, a felony of the fourth degree. He faces a maximum of seven and a half years.
Sentencing was set for March 29. A pre-sentencing investigation, victim impact statement and EOCC evaluation were ordered.
The crimes were committed 2007-2010 and 2009-2011, with restitution close to $179,000.
Dustin Michael Freeman, 25, 68017 Walnut St., Bridgeport, was sentenced for trafficking in marijuana, a felony of the fourth degree occurring Oct. 3, 2012. He was given five years of community control sanctions.
He will serve up to 90 days in jail with credit for 47 day served. He will serve six months EOCC. His operator’s license was suspended for one year.
Jason Gerald Magnani, 29, 56859 Little Captina Road, Powhatan Point, pleaded guilty to one count attempting to possess weapons under disability, a felony of the fourth degree occurring Nov. 14, 2012. Sentencing was set for March 15. EOCC, Southeast and Crossroads evaluations were ordered. He faces a maximum of 18 months.
Samuel Clifford Moore, Martins Ferry, was arraigned and pleaded not guilty to eight counts of theft, felonies of the fifth degree occurring July 2, 2012. Status conference was set for March 1, with plea agreement April 12 and trial April 18.
Bond was set at $10,000. He faces a maximum of eight years.
