Fregiato handles heavy case load
ST. CLAIRSVILLE Belmont County Common Pleas Court saw a heavy caseload of pleas and sentences Monday.
Judge Frank Fregiato presided.
Tonia Cross, 31, 1304 Hukill St., Brilliant, was given a suspended sentence of 18 months and community control sanctions including six months jail, six months EOCC. She was convicted of illegal processing of drug documents, a felony of the fourth degree occurring Jan. 25, 2011.
Gina Marie Geilinger-Palmer, 20, 53931 Pipe Creek Road, Jacobsburg, pleaded guilty to possession of drugs, a felony of the fourth degree occurring July 10, 2013. Sentencing was set for Sept. 30. A pre-sentence investigation was ordered.
William Joseph Gibbons, 30, incarcerated, pleaded guilty to burglary, a felony of the third degree occurring June 27, 2013. Sentencing was set for Oct. 14. A pre-sentence investigation and EOCC evaluation were ordered.
Barbara Ann McGhee, 56, 1869 Belmont St., Bellaire, was sentenced on one trafficking in drugs, a felony of the fifth degree occurring Oct. 5, 2012, and one count possession of cocaine. She was given a suspended sentence of 12 months for each for a total of 24 months. She will serve six months jail, six months EOCC. A hearing was scheduled for Sept. 30 to argue for house arrest due to illness.
Edward Whitmore Davis, 45, 55370 Colerain Pike, Martins Ferry, was sentenced on one count of burglary, a felony of the third degree occurring March 28, 2013, one count theft with a firearm specification, a felony of the third degree, and one count theft of a motor vehicle, a felony of the fourth degree. He will serve three years on each of the third degree felonies, served concurrently, and one year for the fourth degree felony for a total sentence of four years.
Justin Michael Lunsford, 22, 60868 Ray-Ramsey Road, Jacobsburg, saw the revocation of his community controls after admitting to violating his probation. He was given a sentence of 12 months in the penitentiary. He was originally convicted of theft, a felony of the fourth degree occurring Oct. 16, 2011.
Kitty Jo Lewis, 34, 401 Dresden Ave., Steubenville, was sentenced on one count of identity fraud, a felony of the fifth degree occurring June 29, 2009. She was given a suspended sentence of 12 months, and will be subject to three years of community-based controls, including six months jail, six months EOCC.
John Richard Phillips, 51, 359 Wesley Road, Belmont, pleaded guilty to breaking and entering, a felony of the fifth degree occurring March 1, 2011. Sentence was set for Sept. 30. A pre-sentence investigation was ordered.
Cody Lee Stirewalt, 20, 408 Park St., Barnesville, pleaded guilty to theft, a felony of the fourth degree occurring July 8, 2013. He was sentenced to 18 months in the penitentiary with credit for time served. He was recommended for the military program.
Stirewalt also appeared before Common Pleas Judge John M. Solovan II and saw the revocation of his community controls for consuming alcohol and failing to make payments. He was originally charged with intimidation of a witness, a felony of the second degree. He was given a sentence of four years with credit for 913 days served, plus time served from July 9, for a total sentence of 18 months to be served concurrently with his sentence in Fregiato’s court.
