Solovan hands out sentences

ST. CLAIRSVILLE Several pleas were heard and sentences handed down during Friday’s session of Belmont County Common Pleas Court. Judge John M. Solovan II presided.

Robert Lee Asbury, 31, Wheeling, was sentenced on one count of burglary, a felony of the fourth degree occurring Oct. 8, 2012. He received five years of community control sanctions, including up to five months jail with credit for 102 days served, followed by six months at the East Ohio Correctional Center (EOCC) before being released.

Benjamin Scott Fador, 36, 319 South Main St., Bethesda, was unable to reach a plea agreement and will proceed to trial Oct. 15.

He is accused of aggravated robbery, occurring Jan. 12, 2013.

Austin Stephen Peroni, 109 Clairborne St., St. Clairsville, pleaded no contest to attempted theft of an automobile, a felony of the fifth degree occurring June 20, 2013. His sentence was set for Nov. 22. A pre-sentence investigation and victim impact statement were ordered.

Ryan Allan Puskarich, 28, 67712 Lloydsville Alley, St. Clairsville pleaded guilty to assault on a peace officer, a felony of the fourth degree occurring Feb. 26, 2013. A pre-sentence investigation and victim impact statement were ordered. Sentencing will be set after his evaluation at Southeast Inc.

Keith Nicholas Vinka, 22, 3745 Monroe St., Bellaire pleaded guilty to one count burglary, a felony of the third degree occurring July 27, 2012. His sentence was set for Dec. 6. A pre-sentence evaluation, victim impact statement and EOCC evaluation were ordered.

Tanner Meek, 19, 63087 Toad Hollow Road, was terminated from drug court and will be sentenced Oct. 15. He was originally convicted of trafficking in drugs, a felony of the fifth degree occurring Aug. 17, 2010.

Lori Carol Large, 29, 408 Gomber Avenue, Cambridge, was arraigned and pleaded not guilty to one count of illegal conveyance of drugs onto the grounds of a detention area, a felony of the fourth degree occurring Jan. 24, 2013. A status conference was set for Oct. 25, with plea agreement deadline Nov. 22 and trial Nov. 26. She was released on recognizance.

Solovan hands out sentences

ST. CLAIRSVILLE – Several pleas were heard and sentences handed down during Friday’s session of Belmont County Common Pleas Court. Judge John M. Solovan II presided.

Eban Joseph Beyah, 40, with addresses in Cleveland, Wheeling Island and Wheeling, was sentenced on two counts of trafficking in drugs, a felony of the fifth degree occurring June 28, 2012. He was given a sentence of six months on each count, to be served concurrently with credit for 118 days. Solovan noted Beyah’s four prior prison sentences and history of drug-related offenses.

Holly Jo Logan, 32, 116 Pointissia Road, Scio, was sentenced on one count of unlawful sexual conduct with a minor, a felony of the third degree occurring Dec. 1, 2012. She will serve up to 30 days in jail and six months EOCC. She will be classified as a Tier 2 offender. Solovan noted the psychological and emotional harm done to the victim, a boy of 15. He also noted Logan’s attempt to minimize the crime. He also pointed out the impulsive aspect of the offense.

Daryl Jay Lucas II, 19, 217 East Church St., Barnesville, pleaded guilty to one count complicity to safecracking, a felony of the fourth degree, two counts breaking and entering, a felony of the fifth degree, one count receiving stolen property, a felony of the fifth degree, one count disrupting public services, a felony of the fourth degree, one count theft, a felony of the fourth degree, and one count possession of criminal tools, a felony of the fifth degree.

Sentence was set for Nov. 8. He faces a maximum sentence of eight and a half years.

Charges include receiving property from the theft of 600 feet of copper wire from AT&T, disrupting telephone server. The wire has a value of more than $7,500. A victim impact statement was ordered from the two home owners and AT&T. A pre-sentence investigation, Crossroads and EOCC evaluations were also ordered after defense asked Solovan to consider Lucas’ longtime addiction to heroin.

Jennifer Jo Murphy, 38, 53805 Sustersic Avenue, Bridgeport, pleaded guilty to theft a felony of the fourth degree occurring Sept. 8, 2012. Sentence was set for Nov. 22.

A pre-sentence investigation, victim impact statement and EOCC evaluation were ordered. She faces a maximum sentence of 18 months and restitution in the amount of $11,321.

Charles Allen Redmond, 22, Powhatan Point, admitted to his termination from drug court after being terminated from EOCC. He saw the revocation of his community controls and was sentenced to 90 days of jail and 90 days community control sanctions. He was originally convicted of theft, a felony of the fifth degree occurring July 19, 2012.

Casey Glenn Warnock, 30, 1153 National Road, Wheeling, pleaded guilty to one count of receiving stolen property, a felony of the fourth degree occurring Dec. 1, 2012. Sentence was set for Nov. 8. A pre-sentence investigation, victim impact statement and EOCC evaluation were ordered.
