Green appears in court Friday

ST. CLAIRSVILLE – The Belmont County Common Pleas Court was in session Friday, with numerous pleas heard and sentences handed down. Judge John M. Solovan II presided.

Robert Green, 56, 52235 National Road, St. Clairsville, appeared in court and saw his trial set for Aug. 5, with plea agreement July 18. He is charged with aggravated vehicular homicide and failure to stop at the scene of a fatal crash. It is alleged that he struck and killed Jason Cattane, 31, of Bridgeport near the North Ebbert Road intersection Aug. 8, 2012.

Michelle Lynn Bell, 40, 67145 Kirkwood Heights, Bridgeport, was sentenced for attempted failure to comply with the order or signal of a police officer, a felony of the fourth degree occurring Aug. 16, 2013. She was given three years of community controls.

She was sentenced to five days in jail, with credit for five days served, and she will be subject to house arrest for 60 days. She was subject to a Class 2 operator’s license suspension for three years.

Defense asked Solovan to consider Bell’s medical condition and need for treatments, as well as her prior law-abiding life.

Solovan noted the dangerous situation created by Bell leading law enforcement in a five-minute chase at speeds of 80-90 miles per hour for three miles. He pointed out that she claimed medical factors led to the crime, but admitted to consuming alcohol.

Brian Eric Getzlaff, 25, 65227 Porterfield Road, St. Clairsville was sentenced for burglary, a felony of the fourth degree occurring Nov. 28, 2011. He was given a sentence of 18 months in the penitentiary, with credit for 234 days. Solovan noted that Getzlaff was terminated from drug court for positive tests and two felony offenses. Solovan will consider judicial release Sept. 12 if the restitution of $34 hundred is paid in full.

James Louis Kempf, 45, 23310 West 23rd St., Bellaire, saw the revocation of his probation and was sentenced to 23 months in the penitentiary with credit for 14 months served, jail and EOCC time. He was originally convicted of burglary and breaking and entering.

Cody Agler, 19, Bellaire, pleaded guilty to robbery, a felony of the third degree occurring Sept. 6, 2013. He faces a maximum sentence of 36 months. Sentence was set for July 11. A pre-sentence investigation and victim impact statement were ordered.

Adam Michael Shanks, 23, Warnock pleaded guilty to burglary, a felony of the third degree occurring Nov. 3, 2013. Sentence was set for July 18. A pre-sentence investigation and Crossroads and EOCC evaluation were ordered. He faces a maximum of 36 months.

Christopher L. Hicks, 28, 2103 Pennsylvania Avenue, Weirton, was arraigned and pleaded not guilty to two counts trafficking in drugs, each a felony of the fifth degree. His pre-trial was set for May 27, with plea agreement June 9 and trial June 26. Bond was set at $25 hundred after completing his 10-day jail sentence. He faces a maximum of 24 months.

Tina Eunice Jaworski, 44, 68995 Clearview Acres, Bridgeport, pleaded guilty to one count of aggravated assault, a felony of the fourth degree occurring Oct. 27, 2013. Sentence was set for July 11. She faces a maximum of 18 months.

An EOCC and pre-sentence investigation were ordered. A victim impact statement and drug and alcohol evaluation were also ordered.

Ashley Ann Carter, 31, 35091 Main St., Barnesville, pleaded guilty to one count trafficking in less than five grams of cocaine, a felony of the fifth degree occurring Oct. 8, 2013. Sentence was set for May 27. A drug and alcohol evaluation was ordered.

She faces a maximum of 12 months.
