Fregiato holds Common Pleas Court

ST. CLAIRSVILLE – Several pleas were made as well as sentences during Monday’s session of Belmont County Common Pleas Court. Judge Frank Fregiato presided.

William Ray Cunningham, 28, 3133 Guernsey St., Bellaire, was sentenced on one count of burglary/trespassing into an occupied structure, a felony of the third degree, and burglary, a felony of the fourth degree. He was sentenced to 36 and 18 months in the penitentiary, consecutively, for a total of 54 months, all suspended. He was given three years community control sanctions. He will serve six months jail, six months EOCC.

Nicole Marie Gust, 21, 3109 Washington St., Bellaire, saw her plea agreement set for July 28 and trial set for Aug. 31. She is accused of complicity, a felony of the fifth degree occurring May 9, 2013. Bond was set at $20,000. She is currently on supervised release from federal court but held on her current charge.

Kerry Alan Howell, 52, 319 South Main St., Bethesda, was sentenced for aggravated assault, a felony of the fourth degree occurring Dec. 21, 2013. He was given a sentence of 18 months in the penitentiary with credit for time served. Fregiato noted Howell’s history, adding that he is accused of DUI while on pre-trial supervision for this crime.

Andrew Hython Jr., 50, 816 Vine St., Martins Ferry, will go to trial July 17. He is accused of trafficking in drugs, a felony of the third degree occurring Dec. 8, 2012.

Connie Sue Kunze, 28, 23331 West 23rd St., Bellaire, was self-terminated from drug court and was sentenced for counts of possession of drugs, a felony of the fifth degree occurring Dec. 28, 2011. She was given two consecutive sentences of 12 months each, suspended. She was given three years of community controls. She will serve six months jail, six months EOCC. She was given credit for 37 days.

Jason Gerald Magnani, 29, 57161 Krieckbaum Road, Jacobsburg, saw the revocation of his probation after admitting to six of seven violations. The seventh is being charged as a separate offense. Sentence was set for July 21. A pre-sentence investigation was ordered. He was convicted of receiving stolen property, a felony of the fifth degree occurring Sept. 1, 2011.

Mark Duane McEndree, 27, 46393 Firehouse St., Belmont was arraigned and pleaded not guilty to aggravated robbery and intimidation, occurring March 22, 2014. He saw the revocation of his bond. His pre-trial and bond hearing was set for Aug. 4, with plea agreement set for Sept. 2 and trial Sept. 24.

Alyssa Novella McGhee, 27, 428 36th St., Bellaire, pleaded guilty of trafficking in drugs, a felony of the fifth degree with a specification of criminal forfeiture occurring Jan. 21, 2014, and two counts of possession of drugs, felony of the fifth degree.

Loretta Jean Minor, 35, 4025 Riffle Drive, Moundsville, pleaded guilty to theft, a felony of the third degree occurring Feb. 15, 2014. Sentence was set for July 21. A pre-sentence investigation and victim impact statement were ordered.
