On the surface it looks like Osaka loses. Even if they do, there's a big difference between foot traffic coming in the mall and vehicular traffic going to Panda. Osaka's attorney isn't helping his client by throwing gas on the fire.

Really?? This is like comparing apples to oranges, pardon the cliche. They are two totally different types of restaurants. The only thing they have in common is the cuisine. Osaka is supposed to be an upper class sit-down hibachi style restaurant while Panda is more of a call-in/takeout. This lawsuit is frivolous and ridiculous. Sounds to me like the owners of Osaka are trying to find a way to get out of their lease.

The cuisine is what Osaka is disputing. If the stipulation expired upon renewal then it is game over for Osaka. What responsible landlord would allow an exclusive category like this in perpetuity?

Defamation: The action of damaging the good reputation of someone. In this particular case would be the Mall as they claim. Huh! I didn't realize that they had such a high regard for themselves. It's a wonder they don't cry defamation to the Highlands in Triadelphia. Furthermore, Osaka does offer take-out & another restaurant in the area will effect their business. And BunnyHuny, would you be support 2 or 3 McDonalds in the immediate area & expect all of them to survive? Remember the Mall HAD 2 Starbucks & only 1 survived. In closing, if the Mall could flood the area with 5 Chinese Restaurants they would probably do it.

In answer to Cotton, there are 2 McDonald's. One is in the Mall perimeter and the other is in WalMart. Both are surviving. Count the Subways in a 3 mile radius. All are surviving. A little competition is good, upping the ante, so to speak. The food will get better, the service will get better. The consumer will benefit because the sole business doesn't just rest on their laurels because they are the only game in town.
