ST CLAIRSVILLE - Former Martins Ferry Police Chief Barry Phillip Carpenter appeared in Belmont County Common Pleas Court today seeking early release from prison.
Judge John Solovan II granted judicial relief. Carpenter was rendered to five years of community control sanctions.
Carpenter remains in jail until space opens at the East Ohio Corrections Center in Wintersville. That will be followed by 12 months of intensive probation supervision and 42 months of regular probation.
Carpenter pled guilty in September of 2011 to three counts of receiving stolen property, felonies of the fourth degree and reduced from of his prior charges of theft of firearms from the police department.
Carpenter's legal woes were tied to the surrogate mother for actress Sarah Jessica Parker. He was one of two area police chiefs who assisted in a plan to give information to tabloid reporters regarding the identity of a local woman serving as Parker's surrogate mother. She gave birth in 2009.
Carpenter was originally sentenced to two years and eight months in jail. Theft charges were added later as the result of a 10-month BCI&I investigation.
