Solovan hands down sentences

ST. CLAIRSVILLE Several sentences were handed down during Friday's session of Belmont County Common Pleas Court. Judge John M. Solovan II presided.

Debbie A. DeAngelis, 59, 1312 Roosevelt Ave., Martins Ferry, was sentenced on a count of aggravating trafficking in drugs, a felony of the fourth degree occurring March 13, 2013. She was sentenced to five years of community control sanctions, including 60 days in jail with credit for three days served, and six months EOCC. She will receive mental health counseling.

Defense had asked for community controls, asking that Solovan consider that while items she sold were labeled as herbal incense and potpourri, and carried labels from the vendor informing DeAngelis that they were legal. In addition, of the several businesses that had sold the items in the county, hers was the last to get involved and sold the least.

"This particular crime has caused harm," Solovan said. "This type of behavior will not be tolerated."

Jason Bernard Herman, 39, 55551 Bloomingdale St., Bridgeport, was sentenced for felonious assault, a felony of the second degree occurring Sept. 9, 2012, and discharge of a firearm on or near a prohibited premises, a felony of the third degree. He admitted to shooting his weapon into an automobile. Solovan noted Herman's issues of drug and alcohol abuse. He was sentenced to three years for the first count and 12 months for the second. The terms will run concurrent for a total of three years in the correction center. Herman was given credit for 15 days.

"You put lives at risk," Solvoan said. "You're fortunate no one was killed."

Keith Nicholas Vinka, 23, a Wheeling resident who will live in Bergholz upon release, was sentenced for burglary, a felony of the third degree occurring July 27, 2012. He was given a sentence of five years community control sanctions. He will serve six months jail with credit for 163 days, and six months EOCC. Defense asked Solovan to consider Vinka's mental health issues.

Jason Brian Addison, 27, 1717 Belmont St., Bellaire, was arraigned and pleaded not guilty to two counts trafficking in less than five grams of cocaine. Plea agreement was set for Jan. 3 and trial set for Jan. 9. Bond was continued at $2,500.

Cody Wayne Agler, 19, 64670 Bel Capre Apartments, Bellaire, pleaded not guilty of one count aggravated robbery with a deadly weapon, a felony of the first degree occurring Sept. 6, 2013. The felony carries a sentence of 11 years with an added three years for the firearm specification. He also faces a charge of transporting a firearm in a car, with the weapon accessible to a passenger, a felony of the fourth degree. He faces a maximum total of 15.5 years. A status conference was set for Jan. 3, with plea agreement Jan. 17 and trial Jan. 28.

Thomas Douglas Brabham, 29, 1817 Hill St., Martins Ferry, pleaded guilty to two counts of trafficking in drugs, a felony of the fifth degree occurring April 9, 2013. Sentence was set for Jan. 31. A pre-sentence investigation and EOCC evaluations were ordered.

Ferrell Alonza Brooks, 44, 2955 E.66, Cleveland, pleaded guilty to one count trafficking in drugs, a felony of the fifth degree occurring July 3, 2013. Sentence was set for Jan. 31. A pre-sentence investigation and EOCC evaluation were ordered.

Bradley Wayne Crozier, 27, 58820 Homco Road, Shadyside, pleaded guilty to one count of burglary, one count theft of firearms, felonies of the third degree, and one count theft of jewelry, a felony of the fourth degree occurring April 10, 2013. Sentence was set for Jan. 31, a pre-sentence investigation and victim impact statement were ordered.

Brandon Michael Elliott, 22, 41 East 34th St., Shadyside, was terminated from drug court after testing positive and failing to comply with the terms of the program. His sentence was set for Jan. 17. He was originally charged with possession of drugs, a felony of the fifth degree occurring Oct. 4, 2012.

Austin Andrew Hill, 19, 102 Sycamore St., Powhatan Point, saw his termination from drug court after admitting a violation. Sentence was set for Jan. 31. He was originally charged with burglary, a felony of the second degree occurring July 22, 2012.

Vondell McCall, 31, 305 Mehaffey Court, Cambridge, pleaded guilty to illegal conveyance of drugs into the Justice Center, a felony of the third degree occurring Sept. 2, 2013. Sentence was set for Jan. 17. A pre-sentence investigation and EOCC evaluation were ordered.

Kelvin Lamar Rivens, 27, 3100 Placid Road, Davidson, saw his plea agreement set for Jan. 3 and his trial date set at Jan. 14. He is accused of weapons under disability, a felony of the third degree.

Warrants were issued for:

Miranda A. Bonfini, 25, 503 Morganstown Avenue, Barnesville.

Alysha Celeste Gould, 613 Walden Avenue, Tiltonsville.

Ashleigh Chantelle James, 27, 137 Clark Avenue, Powhatan Point.
