Revocations, drug cases top court proceedings

ST. CLAIRSVILLE — A plea agreement has not been ruled out in the case of Dermial Herbert Mills, 34, who is accused of multiple drug crimes.

Mills, with addresses in Bellaire and Cleveland, appeared before Belmont County Common Pleas Judge Frank Fregiato on Monday. He remains set for trial Sept. 20, but a resolution may be in the works.

Mills is accused of felony charges including one count of trafficking in drugs, one count of possession of drugs and multiples counts of trafficking in drugs, in the vicinity of a school.

Belmont County Chief Assistant Prosecutor Kevin Flanagan reported on the progress of evidence sharing, saying the video of the traffic stop involving Mills has been given to Mills’ attorney, Edward L. Gillison Jr. who said he will discuss the substance of the video with Flanagan.

Gillison said a plea agreement remains possible in the near future.

Mills is being held without bond on charges stemming from a traffic stop on Interstate 70 at milepost 210, reportedly due to a speeding violation. A K-9 officer was deployed and showed a positive indication for the presence of controlled substances, according to reports. Deputies reportedly found 93 grams of cocaine on Mills. Multiple cellular phones also were seized during the traffic stop. The sheriff’s department estimated the street value for the cocaine at about $20,000.

A man reportedly in the vehicle with Mills, Scott Beveridge, 36, of Bellaire, is expected to have his case heard by the grand jury in September, with a possible arraignment to follow. He faces charges of possession of cocaine and trafficking in cocaine, after 87 grams of cocaine were allegedly found on him. He is currently being held at Belmont County Jail without bond, after an alleged charge of possession of drugs while out on bond saw that status revoked.

In other matters before Fregiato, Kayla Renee Williams, 29, of 248 W. 41st St., Shadyside, was sentenced after being terminated from drug court for failing to comply with the program. She was originally convicted of two felony counts of trafficking in drugs on Dec. 12, 2016. Her defense attorney asked Fregiato to consider Williams’ efforts at rehabilitation, including refraining from drug use and finding employment. Williams expressed regret but said the experience in drug court has helped her.

“I may not have completed (drug court), but me going to (the Eastern Ohio Correction Center) was the best thing that happened to me,” she said. “I’m sorry that I didn’t make it through your program.”

Fregiato imposed three years of community controlled sanctions, including six months in jail and six months at the Eastern Ohio Correction Center. She was given credit for 227 days and will serve the balance in jail, having already completed a term at the correction center. A violation will result in 12 months in prison.

Franklin Dale Welch, 28, incarcerated, of Alledonia, saw his trial set for Oct. 3, with a plea agreement set for Sept. 24. He faces felony charges of possession of drugs from a Dec. 17, 2017 arrest, and failure to comply with the order or signal of law enforcement on April 30. The failure to comply charge stems from an attempted traffic stop by a Belmont County Sheriff’s deputy stationed on the intersection of Interstate 70 westbound and Banfield Road, who recognized there was an active warrant out for Welch. Welch allegedly fled, leading law enforcement on a chase on National Road, passing several cars by driving through grass on the left side of the road. Speeds were reportedly as high as 95 miles per hour before Welch stopped and attempted to flee on foot through a wooded area. Officers deployed a taser multiple times.

Brody Masciarelli, 23, of 66000 North Moss Run Road, Bellaire, saw his probation revoked after admitting to violating his community controls. His sentence was set for Sept. 24. He was originally convicted of two counts of trafficking in drugs in the vicinity of a school or juvenile occurring Oct. 7, 2015.

Timothy Ryan Abate, 23, of 50276 Church St., Barton, was sentenced for violating his probation. He will serve the remainder of his one-year sentence in the Belmont County Jail, having already served 334 days. He was originally convicted of two felony counts of trafficking in drugs on April 19, 2016.

Alexandria Cleressa Bates, 27, of 420 N. Chestnut St., Barnesville, pleaded guilty to trafficking in drugs occurring March 28. Her sentence was set for Sept. 24. A pre-sentence evaluation, victim impact report and Eastern Ohio Correction Center evaluation were ordered.

Tony Allen Gordon, 32, of 122 Kennard Ave., Barnesville, pleaded guilty to felony possession of drugs occurring March 28. His sentence was set for Sept. 24. A pre-sentence investigation, victim impact study and Eastern Ohio Correction Center evaluation were ordered.

Trever Da’sean Nettles, 21, of 4605 Noble St., Bellaire, saw his probation revoked after admitting to violating his community controls. His sentence was set for Sept. 24. He was originally convicted of carrying a concealed weapon occurring June 21, 2017.

Sloma Esther Waryck, 25, of 60042 Watt Road, Jacobsburg, saw her probation revoked after admitting to violating her community controls by failing drug screenings. Her sentence was set for Sept. 24. She was originally convicted of felony endangering children occurring Jan. 17, 2014.
