Two men arraigned for vehicular homicide cases

ST. CLAIRSVILLE — Two men were arraigned before Belmont County Common Pleas Judge Frank Fregiato on Thursday on unrelated counts of aggravated vehicular homicide.

Donald Shriver, 26, of 51880 SR 145, Beallsville pleaded innocent to a misdemeanor OVI charge and two counts each of second- and third-degree felony aggravated vehicular homicide in a crash that occurred in January.

His pretrial status conference is set for Nov. 1 with a plea agreement hearing Dec. 13 and trial Jan. 4.

The incident reportedly occurred close to a bar outside Beallsville where Shriver was leaving.

“His two passengers were killed,” Belmont County Prosecutor Kevin Flanagan said, adding they were Josh Stewart, 23, of Clarington and Cody Mundy, 25, of Beallsville.

The different felony charges relate to whether Shrive was intoxicated at the time.

Daniel Dayton, 30, of 53081 German Ridge Road, Powhatan Point was arraigned for second-degree felony aggravated vehicular homicide for an incident that occurred in April. He also pleaded innocent.

His pretrial is set for Nov. 29 with a plea agreement hearing Jan. 10 and trial Jan. 25.

“We believe after leaving a bar, he wrecked his vehicle on Ohio 7 near Shadyside and his passenger was ejected also,” Flanagan said.

The passenger was Kyle Bowen, 36, of Clarington.

Flanagan added that both men are believed to have been intoxicated at the times of their respective crashes.

“The allegation is that they were under the influence while operating the vehicles at the time of the crash,” Flanagan said.

Neither man is permitted to operate a motor vehicle. A recognizance bond was continued for both.
