Sex, drug cases are resolved

ST CLAIRSVILLE Several sexual and drug related cases were heard yesterday in Belmont Common Pleas Court. Judge John M. Solovan II presided.

Stephen Zachary Spoon, 34, was arraigned Thursday on one count of the rape of 10-year-old child, a felony of the first degree carrying a sentence of 25 years to life. He also faces a second count carrying a sentence of life imprisonment without parole, a count of possession of sexually oriented material involving a minor, a felony of the fourth degree carrying 18 months and a fine of $5,000, and a count of pandering sexually oriented material involving a minor, a felony of the second degree carrying two to eight years.

Trial was set for Oct. 11.

James Givens, 305 Orchard Lane, St. Clairsville, pleaded guilty to five counts possession of child pornography, amended from a prior charge of two counts pandering sexually oriented material involving minors. Each of the five counts is a felony of the fourth degree carrying a maximum of 18 months imprisonment and a fine of $2,500. Givens would also be designated a Tier Two sex offender. A post sentencing investigation and EOCC evaluation was ordered. Sentencing was set for Nov. 18.

Joshua Allen Rittenberry, 35889 Mason Road, Barnesville, pleaded guilty to two counts burglary, felonies of the second degree, one count theft a felony of the third degree and one count breaking and entering, a felony of the fifth degree. He faces a maximum sentence of 22 years.

A drug and alcohol evaluation was ordered. A post sentencing investigation and victim impact statement was ordered. Sentence was set for Nov. 18.

Tesia Cronk, 26, was terminated from drug court for failure to comply and several positive drug screenings. She had pleaded guilty to two counts of possession of drugs, felonies of the fifth degree, October of 2010 after she was found unconscious after a drug overdose from a dermal patch and ingesting cocaine.

Cronk was sentenced to 12 months on each count. The sentences will run concurrently, since the two instances of drug use were part of the same instance. Three years of post release control will follow.

Defense asked Solovan to consider Cronk had no prior felony convictions. Also, she has 208 days in jail to her credit. Solovan noted Cronk’s history, including a juvenile case of assault, disorderly conduct, and drug and alcohol abuse.

He also noted Cronk’s service in the Army. He said he was reluctant to pass sentence and would not oppose intensive prison programs.

Deondre Markel Henry, 21, 73 Main Street, Bridgeport, was sentence to three years imprisonment on one count of aggravated vehicular assault. His driver’s license was also suspended for six years as of August.

He will be evaluated for mental health problems.

Solovan noted Henry’s history of theft, drug possession, obstruction of an officer, assault of an officer, and a pending criminal damaging charge out of Ohio County, West Virginia. He also noted the suffering of the victim.

“I apologize for everyone for what I’ve done,” Henry said.

Vincent Patrick McPherson, 28, 445 North Wabash Street, Wheeling, pleaded guilty one on count possession of less than a gram of heroine, a felony of the fifth degree occurring July 6. A post sentencing investigation was ordered, as was a Crossroads evaluation and EOCC evaluation. Sentencing was set for Oct. 28.

Maura Lattocha, 200 South Marietta Street, St Clairsville, pleaded guilty to illegally conveying prohibited substances into the Belmont Justice Center, a felony of the third degree occurring Aug. 11. A post sentencing investigation and EOCC evaluation was ordered. Sentencing was set for Nov. 18.

Seth Shumaker, 58980 Hunter Road, Bethesda.

Justin Baxter, 401 Marion Street, Bridgeport.
